Skip permit: Scottish Borders Council

If the skip sits on a Scottish Borders public road, you need Section 85 permission from Scottish Borders Council under the Roads (Scotland) Act 1984 – not Highways Act 1980. The builders’ skip application form (Issue 3, March 2025; rechecked 11 September 2026) charges an application fee of £55 valid for one month from the grant date, then £55 for each subsequent monthly period. Return the form at least two working days before the skip is required.

The statutory hook is Roads (Scotland) Act 1984, section 85.

Who applies

The form is completed by the skip owner (applicant). Email roadworks@scotborders.gov.uk. In practice the hire firm usually applies – ask them at booking.
